New ordinance on the right of first refusal and repurchase in Barcelona

The BOPB of 29 December 2025 published the final approval of the Ordinance regulating the subjection of residential properties to the rights of first refusal and repurchase in the city of Barcelona. This regulation does not introduce these rights ex novo —they have been in force since the 2018 MPGM— but it does substantially redefine their practical scope and enforceability.


The main change lies not so much in the material extension of the right as in its procedural, economic and organisational specificity, which significantly reduces the margins of uncertainty that existed until now.


This regulation establishes that the right of first refusal can not only affect entire buildings, but can also be applied to individual flats, when these have certain characteristics or are located in areas specifically defined by urban planning.


In particular, the possibility of exercising the right of first refusal and repurchase extends, among other cases, to dwellings located in areas undergoing renovation or conservation, to empty dwellings, to dwellings leased under compulsory extension contracts, and to newly built or recently completed dwellings under certain conditions.


The aim of this regulation is to facilitate the expansion of the housing stock for public policies and to ensure more efficient management of land and housing.
